Welcome to WEBTUNE LLC ("WEBTUNE," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, products, and services. By accessing our website or purchasing any services from WEBTUNE LLC, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Business Information

WEBTUNE LLC is a limited liability company organized and operating under the laws of the state in which it is registered. WEBTUNE LLC provides website design and digital marketing services to local businesses.

2. Services Provided

WEBTUNE LLC provides professional digital services, including but not limited to:

  • Website design and development
  • Meta Ads Management for Facebook and Instagram
  • Marketing automation systems, including missed-call text-back, Google review requests, and online booking
  • Ongoing website hosting, maintenance, and support (where applicable)

Services and features vary by plan. We reserve the right to modify, update, suspend, or discontinue any service at any time without liability.

3. Subscription Plans and Billing

WEBTUNE LLC offers monthly subscription plans and one-time setup fees as displayed on our website. All payments are processed securely through Stripe. By purchasing services, you authorize WEBTUNE LLC and Stripe to charge your selected payment method on a recurring monthly basis until cancellation. Setup fees are charged once at the start of service and are non-refundable. You are responsible for maintaining accurate billing information and for all applicable taxes.

Failed or Late Payments: If a payment fails or is declined, services may be suspended or terminated until payment is successfully processed.

4. Cancellation and Refund Policy

You may cancel monthly services at any time. Cancellation stops future billing but does not retroactively refund charges already paid. Monthly fees are non-refundable once billed. Setup fees are non-refundable under all circumstances. WEBTUNE LLC reserves the right to terminate services for non-payment, misuse, or violation of these Terms.

5. Client Responsibilities

You agree to:

  • Provide accurate, lawful, and complete information and content
  • Own or have legal rights to all text, images, logos, and materials you provide
  • Ensure your website content complies with all applicable laws and regulations
  • Review your website and automation tools regularly for accuracy and compliance

WEBTUNE LLC is not responsible for content provided by the client.

6. Intellectual Property

All designs, websites, code, automations, frameworks, templates, and proprietary tools developed by WEBTUNE LLC remain our intellectual property until all outstanding balances are paid in full. Upon full payment, ownership of client-specific website content and designs transfers to the client. WEBTUNE LLC retains ownership of all proprietary systems, software, templates, and processes used to deliver services. WEBTUNE LLC may display completed work in its portfolio and marketing materials unless otherwise agreed in writing.

7. Automation Disclaimer

Automation tools are provided to assist with customer engagement and lead capture. WEBTUNE LLC does not guarantee lead conversion or uninterrupted operation. You are responsible for monitoring automation activity and ensuring compliance with applicable laws, including consumer protection and data regulations. WEBTUNE LLC is not liable for missed leads or automated errors.

8. Results Disclaimer

WEBTUNE LLC does not guarantee specific outcomes, including but not limited to increased traffic, leads, sales, revenue, or search rankings. Results vary based on numerous factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, WEBTUNE LLC shall not be liable for any indirect, incidental, consequential, or special damages, including loss of profits, data, or business interruption. In all cases, WEBTUNE LLC's total liability shall not exceed the amount paid by the client in the three (3) months preceding the claim.

10. Third-Party Services

WEBTUNE LLC may rely on third-party tools and platforms, including but not limited to Stripe, hosting providers, and AI services. We are not responsible for outages, errors, or issues caused by third-party services.

11. Privacy

Your information is handled in accordance with our Privacy Policy. We do not sell your personal data and take reasonable measures to protect it.

12. Termination

WEBTUNE LLC may suspend or terminate services immediately if:

  • Payments are overdue
  • The client violates these Terms
  • Services are used for illegal, harmful, or abusive purposes

Termination does not relieve the client of payment obligations incurred prior to termination.

13. Governing Law

These Terms are governed by the laws of the state in which WEBTUNE LLC is registered, without regard to conflict of law principles.

14. Changes to Terms

WEBTUNE LLC may update these Terms at any time. Updated Terms will be posted with a revised "Last Updated" date. Continued use of services constitutes acceptance of the revised Terms.
